Icon Hotlinking and Theft on LJ
There's a thief out there who has found a way to automatically snag things from the LJ picture feed without regard to who (s)he is stealing from or what they are stealing. No credit is being given at all for any of the icons being taken and people posting comments there do not care things are being stolen. All they seem to care about is laughing at people who are demanding this person take the icons down. Just today I found one of my icons on that community so I'm very certain there are icons from others in this very community out there. Also, it seems it's not just icons too it's people's pictures so any related community that posts personal photos should take the same steps as the iconists. Here's the information and what you can do about it as found on book_icons.

Protect yourself from the thief todayCollapse )

Could I (or you, if you'd prefer) crosspost this to animeicons?

Many thanks. :)

Welp, time for everyone to start uploading 100x100 images of goatse.cx to their ljs en masse. That would shut down that comm a lot faster than just a few people disabling lj-feed.

That is an excellent idea.

Hi ((:

I know I'm a complete n00b and everything, but how do I credit a person's works properly? Do I just include it in the description of the icon or do I have to do something else? I feel so n00bish...cause joannad created some lovely icons sometime back and I was wondering if I'm crediting by saying that she was the one who made the icons when describing the icon.

Thanks for helping and sorry if this is considered spam >

the usual way of crediting icons is via keywords in your profile section.

Go to Profile and then Edit Userpics, taking you to the place where you upload your icons.
In the comment section, use the lj-user tag by writing

joannad (unless she prefers you linking to another profile or another name)

Hope this helps! n_n

*headdesk*

I'm such an idiot..

<*lj user=*name of person here*>

Just take out the stars and keep the space between lj and user.

I can't believe I replied so late! Thank you so much for teaching me how to credit properly! I hope it is alright now, I made sure the comments for the icons all had the creator's link in it ((:

Wow I sure was absent for a long time.

Thank you!

I love that comm. Love it to tiny, tiny bits. It's so interesting just to look at.

I wouldn't worry anymore, iconscraper's been suspended.
Chibi Halochibihalo on October 20th, 2006 10:59 pm (UTC)
Thank the heavens. I figured it was in violation of paragraph XVI section 20.

*Cracks knuckles and sighs*

Seems a LOT of people are either, A) Very unfimilar with current CR laws.

Or B) Extremely ignorant and naive.

After reading some of the more recent comments to this rather, brash excusion, I feel it's necessary that I add my two cents in. Of course, I find it rather, depressing that most people replying to this little, escapade who are by opposed to the fact of theft being a real issue indeed need some semblence of a reality check.

As an artist and writer, I have studied CR laws for many years. As is common sense by anyone who fit under a creator catagory. Even so. Aside those aspects, anyone with scruples should he pretty fimilar with CR laws regardless. Which also adds to my dismay considering that it seems a LOT of people fail to have become knowledgeable with these basic, yet very important laws.

As per feral law regarding Copy Right, anything derived there of by a singular artist/writer and or inventor, pretaining that vilable proof of their creation states that said inventer has indeed, generterated a specific piece of work not entirely covered under patten, still has legal rights to claim said work. Now. This falls under things anyone person creates on their own. Such as. Fanart and original artwork. Inventions of original creation. Writing of original and fan creation. And music of original creation. When refered to as 'singular' that means any ONE person. This does not justify a company now whose jurisdiction to CR law is different then singular artists.

Now. Laws that govern companies are far different. Anything considered, 'multi'media' once released and pretaining that no profits are being made, fall under what is called, 'The free, fair use act'. Which signifies what you would know it as, 'public domain'. Now. Any image that falls under said act, becomes available to the public to be used without fear of suit. This also means screencaps and media that is produced by distrubiton companies. Which gets down to icons. Since MOST icons are taken from multi-media, they are being used without violating any form of CR law. However, Because of this, anything done to said images, pretaining it's not fanart or anything singular artist produced, can be altered, changed, added to, etc. Fully clear from any illegial infraction. This is how people are able to use all these wonderful images without actually ENDING UP IN COURT.

Wait. But yet, there's more. Furthermore under the 'free, fair use act', also signifies that any image thereof used to make collabs, icons, backgrounts, etc, pretaining that NO profits are being made, are therefore able to be claimed, and said images redistrubited without consent IS a violation of CR law.

Which goes back to the original concern. Theft. Now. There has been a recent rash of said infractions having been circulating LJ as of late. Moreso, regarding theft. Which comes to my point, and getting to the point of how redistrubiting personal images not only violates CR law, but privacy laws as well. A lot of people seem to be blatantly arrogant to this very concept, and I find it rather, distrubing. Not to mention, downright sickening. A lot of you and be lucky I don't hand pick everyone of your names from this thread, as one is only a few posts up from my own, I suggest you digest this in and well. For until you can provide me with actual, viable excerpts from CR law, or actually, PROVIDE me with a actual LINK to a govermental site depicting CR law; NOW A FUCKING GOOGLE COPYPOST, then please do not post at all. Not only do you make yourself look stupid, but arrogant to boot.

And now to my point about icon theft and the distribution of personal images. Considering that most graphics used are taken from public domain images, thus generating a alercation of the image used, which then falls under the singular act, thus, signifying that anything of said nature does fall under the jurisduction of CR law. By which, the artist can stake claim upon the altered work, and lable it with their name. By reusing this work without conscent IS in violation of this law.
Edward Elric: Sasuke_edward_elric_ on October 20th, 2006 11:55 pm (UTC)
As goes the same with personal images. It doesn't matter whether or not you think that, 'just because it's loaded to the net means anyone can use it'. Oh no it does not. And you people who claim that need to STFU right now. Please. DOn't defile me with your illogical stupidity. Don't try to insult me with your naivity. I don't really care to hear it. For people who think they really know what it's all about are only blowing their stack and letting the steam vent from their ears. Another thing that neauseats me.

Personal imagery also falls under singular artist jurisdiction and law. Misuse of one's personal photo, especially those of actual persons. Thus redistributing these images leads to violation of CR laws and privacy acts. You're defaming and encroaching upon the privacy laws that there are STILL in place when govering certian issues that relate to privacy acts when listing photos. Regardless of whether or not you believe that listing them instantiously makes them PD isn't a good mentality. You're ultimatly abusing CR law and not to mention, stepping toes on someone's privacy. You can't just redistribute anything you want. That's like saying: Oh just because it's on the LOLL INTARNETS I CAN USE IT! doesn't sit too well with federal law. You're trying to tell that just because someone posts their art on the net anyone can use it and without conscent is bullshit. There are still certian laws that govern certian things and you people need a wake up call. Grow a spine and stop your incessant whining. Actually. Learn how to make your own shit and stop bitching just because your shit isn't worthy of stealing.

Sometimes. I just want to slap people. And HARD. e.e;;

In any rate the community has been suspended because it violated the TOS on Hotlinking. The issue is over with until this guy or someone else comes up with another way to hotlink something else from LJ.
Edward Elric_edward_elric_ on October 21st, 2006 09:41 pm (UTC)
I saw that it had indeed, been suspended. Which I didn't find surprising to say the least. But art theft and hotlinking severely gets under my skin. I mean BAAAAAD. And to see the same kind of arrogance that was so crudely displayed in this thread only beafed up my irritation. I am sorry I ranted, but the subject has always been touchy with me. Actually. It's touchy period. And I felt the necessity to add my two cents in.

I hate feeling like I need to educate people. But sometimes, naivity and arrogance run strong enough to blind ones judgement. If people wern't so disillusioned, there wouldn't be issues such as this.
